1. General

By accessing and using our website, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to any part of these Terms, you must not use our website or services.

1.2 Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our website after any such changes constitutes your acceptance of the new Terms.

 

2. Services

2.1 Photography Prints

We offer photography prints for sale through our website. All prints are subject to availability and may be withdrawn at any time.

2.2 Real Estate Listing Services

We provide photography and media services for real estate listings. This includes interior and exterior photographs, virtual tours, drone footage and other related services.

2.3 Event Photography Services

We offer photography services for events, including but not limited to weddings, corporate events, and private parties.

 

3. Orders and Payments

3.1 Placing Orders

All orders for photography prints must be placed through our website. By placing an order, you agree to pay the price listed at the time of purchase.

3.2 Payment Methods

We accept various payment methods, including credit cards, PayPal, and other payment options as specified on our website.

3.3 Order Confirmation

Once you place an order, you will receive an email confirmation. This email confirms that we have received your order and are processing it.

3.4 Pricing

All prices are listed in US Dollars and are subject to change without notice. Prices do not include applicable taxes or shipping charges, which will be calculated and added during the checkout process.

 

4. Shipping and Delivery

4.1 Shipping

We ship photography prints to various locations. Shipping costs and delivery times will be specified during the checkout process.

4.2 Delivery

We are not responsible for delays caused by shipping carriers. Once your order has been shipped, you will receive a tracking number to monitor its progress. Please allow 2-4 days for your retail product to be shipped, plus the shipping time based on the shipping option you selected.  If your print arrives damaged or broken, please contact us! We will happily replace it, but we’ll need a picture of the damage.

 

5. Cancellations and Refunds

5.1 Order Cancellations

Orders for photography prints can be canceled within 24 hours of placing the order. After this period, cancellations are not guaranteed. All works are custom orders. Production of the purchased work(s) begins immediately after purchase, and shipment will occur as soon as possible after production is complete. As a result, the work(s) cannot be cancelled, returned or refunded at any time. In light of the substantial production costs incurred once production has begun, any request to cancel an order or otherwise modify the produced image (e.g., increasing or reducing size, changing image, etc.) will be eligible to a 50% restocking fee. Due to our shipping and production timeline, produced & shipped work(s) are non-cancellable, non-returnable, non-exchangeable and non-refundable. 

5.2 Refunds

Refunds for photography prints are only available in the form of store credit if the product is damaged upon arrival. To request a refund, you must contact us within 7 days of receiving the product and provide photographic evidence of the damage.

5.3 Event and Real Estate Services

Cancellations and refunds for event photography and real estate listing services are subject to the terms outlined in the service agreement provided at the time of booking.  Required is a non-refundable $250 deposit on photography services

 

6. Intellectual Property

6.1 Copyright

All content on our website, including but not limited to photographs, text, graphics, and logos, is the property of Roman Cresci Photography or its content suppliers and is protected by copyright laws.

6.2 Use of Content

You may not reproduce, distribute, or use any content from our website without our prior written consent.

 

7. Limitation of Liability

7.1 No Warranties

Our website and services are provided “as is” without any warranties of any kind, either express or implied. We do not guarantee that our website will be available at all times or that it will be free from errors or viruses.

7.2 Limitation of Liability

In no event shall Roman Cresci Photography be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our website or services.

 

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Texas without regard to its conflict of law principles.
